She d. 1887 in Elizabethtown, N. Y.. He m. (2) in New York, N. Y., 27 Apr. 1897, Mary Richards, b. in Warrensburgh, N. Y., 3 May 1854, dau. of Samuel Thomas Richards, and Mary Pamelia Burhans. She d. 23 Sep. 1918 in Elizabethtown, N. Y..

He was a Civil War veteran, enlisting as a private in the 118th regiment, N. Y. Vols., recruited in Elizabethtown, but attained the rank of major at the close of the war. He then studied law, was admitted to practice and served Essex county as district attorney for several years. He also represented this district in the state senate for two terms. At his death he was county judge and surrogate of Essex county.

Y., 3 Sep. 1876; he received a law degree from Harvard University and was in private practice at 49 Wall St. in Manhattan; he d. 24 Dec. 1924 in New York, N. Y. Some genealogy trees suggest that he was married to Sarah Jane Quirk and had a child, Case James Kellogg, b. 1912 in Montreal, Que., Canada, but every census records James Case as being single, both before and after 1912. Sarah Jane Quirk (1878-1956) was living in New York City in 1910, reportedly single in her family's household, but in 1920, she was living in Chicago, Ill., with a seven year old son, working as a teacher, and reportedly widowed (James case would not die until four years later). It is possible that the child was born out of wedlock in Canada and she then removed to Chicago to avoid scandal.
